Terms & Conditions

1. Our Contract

1.1 These Terms and Conditions govern the supply of goods sold by Plumbline Limited of Unit 10 County Business Park, Clarke Road, Nottingham, NG2 3JJ VAT registered number  679 0836 87, ("we" and "us") to the customer ("you") and constitute the entire and only agreement between us in relation thereto.

1.2All orders placed by you are on the basis of these Terms and Conditions and are subject to acceptance by us by delivery of the goods to you at which point a legally binding contract is constituted between us. The processing of your payment and acknowledgement of your order does not constitute legal acceptance of your order.

 2. Price & Payment

2.1 The price payable for the goods you order is as set out on our web site at the time you place your order.

2.2 We reserve the right to change the price of commodity goods, such as copper, due to market conditions but we will confirm the prevailing price with you before accepting your order. We are not obliged to accept your order for such goods and may decline it or limit the order quantity.

2.3 On occasion, the prices payable of goods advertised on our web site may differ from those prices offered on one of our trade counters, and we are under no obligation to honour any web site price at the counter if there is such a difference.

2.4 Occasionally an error may occur with our web site and goods may be incorrectly priced in which circumstances we will not be obliged to supply the goods at the incorrect price.

2.5 We must receive payment for the whole of the price of the goods you order, and any applicable charges for delivery, before your order can be processed unless we have agreed otherwise in advance in writing.

3. Delivery & Title

3.1 The delivery Policy for the majority of England, Wales and Scotland is that a carriage charge of £5.00 Inc Vat will apply up to an order valued up to £60 including VAT.  Orders valued £100 or over including VAT will be free of charge. Heavy, long or fragile goods which are charged differently see below.  This is based on a three working day delivery schedule.

 

3.2 Outside the UK Mainland. Unfortunately we do not currently deliver outside the UK mainland.

 

 

3.3 Heavy Goods these products are over the maximum weight for standard carriage charges.  The extra carriage is quoted at the cart and checkout pages.  The goods will be sent by pallet on a 48 hour working day delivery service.  Access for a lorry is required and because the delivery is made by an external haulier they will only deliver the pallet using a tail lift and pallet truck, it is your responsibility to unload the pallet and take the goods inside.

3.4 Long Goods These products are over the 2.6m maximum length allowable for standard carriage therefore carriage is quoted separately.

3.5 For reasons of health and safety and to avoid any property damage, most ‘Big Stuff’ items can only be delivered to the exterior of a ground floor location at the delivery address. You must therefore make your own arrangements at your own risk if the relevant item needs to be transported from the delivery location. We will not provide any unpacking, installation or fitting services upon delivery unless otherwise agreed by us.

3.6 You must do all that you reasonably can to enable delivery to take place at the given time and place. If you delay delivery, or delivery fails because you have not taken appropriate steps, we will try to arrange for an alternative delivery date within 30 days or less if possible of the failed delivery. If delivery fails as a result of circumstances within your reasonable control, the cost of any re-delivery shall be borne by you. If we are unable to arrange a date for re-delivery we may cancel your order and refund to you the price that you have paid for the goods, less the failed delivery costs.

 

3.7 Fragile Goods are liable to be damaged in transit, as we have found in the past using an external carrier. Unfortunately we cannot despatch these goods by carrier. The following rules apply:

·         Local delivery
we can deliver by van from a local branch throughout the East Midlands.

·         Orders of Sufficient Quantity
we can facilitate a delivery direct from the manufacturer (normally 14 days delivery).

·         Collection
If you are able to collect the goods from us the then you are welcome during normal business hours.

 

4. Availability

While we endeavour to hold sufficient stock to meet all orders, if we have insufficient stock to supply or deliver the goods ordered and paid for by you, we may supply or deliver a substitute product or refund you the price paid for such goods as soon as possible and in any case within 30 days.

 

 5. Cancellation & Returns

We know that you will be pleased with your purchases from Plumbline Limited. However, there may be occasions when you will need to return items to us. We will refund the cost of the goods and the delivery charge, please contact  returns@plumblineltd.co.uk  to arrange for the goods to be collected. All returns are tested and if the item proves not to be faulty when tested then only the product value will be refunded. You will be charged the actual cost of the delivery and the collection.


5.1 Items Damaged in Transit. If any items were damaged in transit, we ask that you report it to us within 7 working days if the items are visibly damaged on receipt, it's best to sign the carrier's delivery note accordingly. We ask that items be returned to us with their original packaging, complete with all accessories and documentation. Once received back into our warehouse, we'll issue a replacement or full refund to you via your original payment method and reimburse your reasonable return carriage costs.


5.2 Items Faulty on Arrival If your items are faulty on arrival, you have 28 calendar days in which to inform us of the faulty items should be returned in their original packaging complete with all accessories and documentation. Once we have verified the fault, we'll issue a replacement or full refund to you via your original payment method and reimburse your reasonable return carriage costs. We test returned items, and if a returned item is found not to be faulty by our technicians we will return the item to you, in this instance you will be liable for the return carriage.


5.3 If you change your mind or if you have simply changed your mind about any item ordered and you wish to return it, then in line with the Distance Selling Regulations (DSR) you can do so provided you inform us of your decision within 10 days of receipt. The item must not be used and must be 'as new' when returned to us. Once you've informed us that you wish to return goods under the DSR, you have 28 calendar days to do so, at your own expense. Once the item is received at Plumbline Limited, we'll issue a full refund for the product to your original payment method, you are only entitled to a refund on the goods and not any delivery costs.

 

5.4 Plumbline Limited is not responsible for any labour charges incurred during fitment or removal of allegedly faulty (or incorrectly supplied or ordered) parts. Please advise Plumbline Limited of any problems with shortages or carrier damage within 5 working days of receipt. We regret that beyond this time, due to circumstances beyond our control we may be unable to process your claim. Whilst we endeavour to deliver orders as stated about, these are only estimations and do not take into consideration unforeseen circumstances with our couriers or general supply.

 

 

 

6. Liability

PLEASE READ THIS CLAUSE

6.1 If you have notified us of a problem with the goods within 30 days of delivery, we will (subject to clause 4) either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question.

6.2 We shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. Our liability to you shall not in any event include losses related to any business of yours, such as loss of profits or business interruption; neither will we be responsible to you for any other loss which is not a foreseeable consequence of us being in breach of these Terms and Conditions or our legal duties.

6.3 This does not affect your statutory rights if you are a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.

6.4 Goods are intended for use in the UK only and we cannot confirm that the goods comply with any laws, regulations or other standards applicable outside the UK. All goods are sold in accordance with the manufacturer’s specifications and are subject to any qualifications, representations or instructions contained in the documentation associated with the goods.

 

6.5 If you are a trade customer and subject to Clause 6.3, we will not be responsible to you or, in the event that you are undertaking work for another person, to any other person, for the use or installation of any goods by you. Accordingly, if you are a trade customer, you hereby agree to hold us harmless, and indemnify us against any liability associated with, any claim or allegation that we are responsible for any failings in the installation or use of goods that we supply.

 7. Age Requirement for Specific Goods

Where you place an order for age-restricted goods such as solvents and knives, you confirm that you are over the age of 18 and that delivery will be accepted by a person over the age of 18. We reserve the right to cancel your order if we reasonably believe you are not legally entitled to order certain goods.

8. Force majeure

We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).

 

9. Privacy policy

Plumbline Ltd is committed to ensuring that your privacy is protected. This policy, together with our terms and conditions sets out the basis on which any personal data we collect from you or you provide us with will be processed by us. We will strictly adhere to the data protection act 1998 and the privacy and electronic communications regulations 2003.

9.1 To protect your security we will ensure that your debit/credit card is not being used without your consent by validating certain other information given to us against existing third party databases By accepting these terms and conditions you give consent for these checks to take place. We may need to disclose your personal data where we are under a legal duty to comply with any legal obligation or in order to enforce or apply our Terms and Conditions and other agreements. We may also need to disclose it to protect our rights, property or safety of our customers or others which includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.
